Effective October 21, 2026
These Terms and Conditions of Use (the "Terms") govern access to and use of the Zoomy mobile application (the "Application") and the electric bicycle and electric scooter rental service (the "Service"). The Service is offered and operated by 3-102-963844 S.R.L., a company organized under the laws of the Republic of Costa Rica, corporate identification number 3-102-963844, which uses the trade name "Zoomy".
Creating an account in the Application requires reading and expressly accepting these Terms, which are available in Spanish for consultation, storage, and download. Merely opening the Application, viewing vehicles, or scanning a QR code does not constitute a rental agreement or, in itself, create a payment obligation. Before each rental is confirmed, the vehicle, rate, calculation method, and specific conditions will be presented so that the User may verify the information, correct errors, and accept or decline. Express confirmation concludes the agreement, and Zoomy will make a transaction receipt available on a durable medium.
Each rental is also governed by the Vehicle Rental Agreement and the specific conditions communicated and accepted before it begins. These Terms establish the general rules for the Application and the Service, and none of their provisions diminishes the non-waivable rights recognized under Costa Rican law.
Only persons over eighteen years of age who have the legal capacity to enter into binding obligations may register, contract for, and operate Zoomy vehicles. Permitting minors to use them is prohibited, even with the authorization of their parents, guardians, or the person paying for the rental.
The User must have the necessary physical and mental abilities, understand how the vehicle operates, and meet the legal requirements for operating it, including any license or authorization required according to its characteristics. Operating a vehicle under the influence of alcohol, drugs, medication, or any condition that impairs attention, balance, or reflexes is prohibited.
Access to the Service requires a compatible device, an internet connection, and sufficient battery power in the device used to operate the Application, as well as any essential technical permissions indicated before contracting. The User bears the data and telecommunications costs charged by their provider. No technological incompatibility or interruption authorizes abandoning a vehicle in the User’s custody.
The User must provide accurate, complete, and up-to-date identity, contact, and payment information; each person may maintain only one Account unless authorized by Zoomy. Zoomy may verify the User’s age, identity, and authorization to use the payment method through proportionate measures, in accordance with the Privacy Policy, and reject registrations containing manifestly false or insufficient information.
The Account is personal and non-transferable. The User must protect their passwords and codes, prevent their use by third parties, and promptly report loss of the device, irregular access, or possible misuse. The User may not share their Account or allow another person to operate a vehicle rented in their name, and each operator must contract for their own Ride.
Zoomy will investigate unrecognized charges and access using the available information and will allow them to be disputed. The use of valid credentials does not, by itself, establish the account holder’s liability for unauthorized transactions; such liability will be determined according to the circumstances and conduct attributable to the parties or third parties.
Zoomy operates a rental system through the Application that, as a general rule, does not require the vehicle to be returned to a fixed station ("dockless" model). The User may locate available vehicles, review their characteristics and conditions, and scan the QR code to request unlocking and confirm the rental through the Application. The Ride will begin when the vehicle is effectively delivered or unlocked.
The availability of the platform does not ensure uninterrupted availability of vehicles or their use outside authorized hours, locations, or conditions. A vehicle’s location on the map does not ensure that it will remain available when the rental is contracted, and an unsuccessful unlocking does not constitute a Ride and must not generate usage charges.
To end the Ride, the User must stop in a safe and permitted location, park without obstructing access or circulation, turn off and lock the vehicle when applicable, and complete the end-of-ride process in the Application, retaining the confirmation. Digital termination does not dispense with a valid physical return; if the system rejects closure or it is not recorded, the reporting procedure in the following paragraph will apply.
Charging and parking points are available at the locations enabled in the Application. Return to a designated point will be mandatory only if communicated before the rental. The User must not connect, charge, or interfere with batteries without Zoomy’s express authorization and instructions.
If a malfunction of the Application, unlocking system, or connection prevents the Ride from being ended, the User must secure the vehicle in a permitted location and contact Zoomy through the available channel, providing its identifier, location, time, and, if possible, photographs. Zoomy will verify the return and adjust the charge to the period of use actually established; failures attributable to Zoomy and subsequent delays in collection will not generate additional charges. A lack of phone battery power or signal does not justify abandoning the vehicle.
Throughout the Ride, the User must wear a suitable, properly fitted helmet, operate only the vehicle they rented, obey traffic signs, and comply with instructions from the authorities and the manufacturer’s technical limits. Carrying passengers, minors, pets, or trailers, or carrying objects that compromise balance, visibility, or the maximum load capacity, is prohibited.
The Vehicle may only be used within the Service Area and in places where its operation is legally authorized. Neither the map, suggested routes, nor the technical ability to unlock it constitutes permission to travel.
Pursuant to Article 124 of Costa Rica’s Road Traffic and Road Safety Law (Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial), self-propelled devices not expressly authorized by law or its regulations may not circulate on public roads. Accordingly, scooters subject to that prohibition may only be used in spaces where their use is legally permitted and with the authorization of the owner of those spaces. Their location on private property does not, by itself, exclude the application of traffic regulations.
Electrically assisted bicycles must be operated in accordance with their legal classification and factory specifications, without modifying their assistance mechanisms, power, or speed. Using any vehicle on sidewalks, highways, beaches, trails, protected areas, or other zones where its operation is prohibited or restricted is forbidden. If signs, rules, or instructions conflict with the map, the more stringent legal restriction will prevail.
The User may not park on ramps, accessways for persons with disabilities, pedestrian crossings, entrances or exits, or block emergency routes. During pauses, the User retains possession and custody of the vehicle and must secure it. The User must stop the Ride in the event of malfunctions, poor visibility, dangerous weather conditions, or any circumstance preventing safe operation.
In the event of an accident, injury, theft, or other emergency, the User must stop, prioritize their own safety and that of third parties, call 9-1-1 when appropriate, and notify Zoomy as soon as reasonably possible. The User must provide truthful information about the event and cooperate reasonably with procedures involving the authorities and insurance, without exposing themselves to risk to pursue or recover a vehicle. Neither GPS nor the Application constitutes a rescue, medical care, or individual monitoring service.
In the event of loss or theft of the vehicle, the User must notify Zoomy as soon as possible and file a report with the authorities when applicable or reasonably required to process the claim. Liability and associated charges will be determined in accordance with the evidence and the provisions on damages, insurance, and payments set forth in these Terms.
The price of each Ride will be the price published in the Application and expressly accepted before it begins. As a reference rate structure, an unlocking fee of US$1.00 and a charge of US$0.50 per minute, plus 13% value-added tax (IVA), are contemplated; those amounts will apply only if they are displayed for the relevant Ride. The Application must disclose the currency, taxes, fixed fees, unit of time, pause rate, and method of calculating the total when it depends on duration. Rate changes will apply only to future rentals, with prior notice.
The User must register a payment method belonging to them or authorized by its holder. By confirming the Ride, the User authorizes the collection of amounts previously disclosed and actually incurred. Deposits, temporary holds, preauthorizations, or optional products will require prior information regarding the amount, purpose, and conditions for release or collection. Registering a card does not constitute authorization for unlimited charges or unsolicited services. Payments may be processed by specialized providers in accordance with their terms and the Privacy Policy.
Additional amounts may only be charged for improper parking, extraordinary cleaning, recovery outside the permitted area, damage, loss, or theft if the circumstances triggering the charge and the method of calculation were communicated before contracting and the act is legally attributable to the User. The amount must be reasonable, itemized, and supported by evidence, with an effective means of review before collection or, where applicable, reimbursement. Normal wear and tear, routine maintenance, and pre-existing damage are excluded. The mere occurrence of theft or damage does not automatically establish the User’s liability.
Cancellation before effective unlocking or delivery will be free of charge. If a fixed period is contracted, an early return does not, in itself, result in a discount, unless an announced condition or applicable legal right provides otherwise. Services not provided, billing errors, and interruptions not attributable to the User will give rise to the corresponding adjustments or refunds. Once entitlement to a refund has been established, Zoomy will arrange the refund to the same payment method within ten business days, unless a shorter legal period applies or a technical impossibility beyond Zoomy’s control is duly disclosed. The statutory right of withdrawal will be respected in the cases and under the conditions in which it applies.
Zoomy will make available a clear, durable receipt detailing the Ride, the amounts charged, and the information needed to request the applicable tax document. The User may dispute charges through the Application, by email, or with their payment provider, without a good-faith claim being deemed fraud. Promotions, coupons, and packages will be subject exclusively to the validity, eligibility, use, and expiration conditions announced before acceptance; they will not result in automatic renewals or recurring charges without express consent.
Disputed charges will be reviewed using the available information. Zoomy will communicate its decision and the reasons for it through a User contact channel and correct amounts that were not properly chargeable; it may not presume fraud solely because a right to file a claim has been exercised.
Before each Ride, the User must visually check the tires, brakes, steering, lights, and locking system, verify that there is no apparent damage, and check the available battery charge. If the User observes an unsafe condition, they must not ride and must report it through the Application or the assistance channel.
Zoomy is responsible for performing reasonable maintenance on its fleet and addressing malfunction reports. The User’s visual inspection does not replace that obligation or give rise to a presumption that no hidden defects existed. Beginning a Ride does not constitute acceptance of defects that could not be detected or a waiver of the User’s rights.
The displayed range and battery level are approximate and vary depending on terrain, weight, temperature, and manner of use. If the vehicle malfunctions during the Ride, the User must stop in a safe location, refrain from continuing to use it, and contact Zoomy for instructions. The User may not repair, modify, dismantle, or tamper with its battery, wiring, GPS tracker, or locking systems.
Operating electric bicycles and scooters entails inherent risks, including falls, collisions, obstacles, traffic, surface conditions, weather, and the actions of third parties. The User acknowledges these ordinary risks and undertakes to adjust their speed, pay attention to their surroundings, and maintain control of the vehicle.
The risk warning does not constitute an advance waiver of legal claims or release Zoomy from liability for defects, inadequate maintenance, breaches, or events for which it must be held liable under the law. Liability for injury, death, property damage, or other losses will be determined in accordance with applicable law and the facts established in each case.
The insurance coverage applicable to each vehicle or activity will be exclusively that provided by policies actually purchased and in force. Before a rental begins, Zoomy will provide accessible information regarding available coverage, its exclusions, deductibles, relevant conditions, and the procedure for reporting an insured event. These Terms do not constitute proof of the existence of any specific policy or promise medical or personal accident coverage where none has been purchased.
Fleet, property damage, or liability insurance is not necessarily equivalent to personal health or travel insurance, so the User may consider their own coverage. Deductibles may only be passed on to the User when there is sufficient legal and contractual basis, and insurance payments and claims against the User may not result in double recovery for the same loss.
The User will be liable for property damage and direct expenses that are legally recoverable and result from negligent or unlawful conduct or conduct contrary to validly accepted obligations, provided that a causal link is established. This may include damage to the vehicle, harm to third parties, and reasonable location or recovery costs, subject to the applicable rules of evidence and liability.
Any indemnification must correspond to actual, verifiable harm that has not been recovered by other means. Repairs may not include improvements unrelated to the damage, and in cases of total loss, the reasonable value of the property before the event and its depreciation will be taken into account. Loss of income and defense expenses may only be claimed when legally recoverable and duly substantiated. The User does not assume liability for acts or omissions attributable to Zoomy, its affiliates, personnel, contractors, or third parties.
It is prohibited to manipulate rates, geofences, GPS location, QR codes, locks, unlocking systems, or safety functions; circumvent technological safeguards; access systems or data without authorization; introduce malicious code; or use third-party payment methods without permission.
It is also prohibited to share the Account; lend, transfer, or sublease the Vehicle; ride outside permitted areas; use it for unlawful purposes, races, or risky maneuvers; transport it without authorization; alter its components; exceed its load capacity; or use it for deliveries, paid transportation, or commercial activities without Zoomy’s prior consent.
Zoomy and its licensors retain ownership of the Application, its software, databases, trademarks, and content. The User is granted a limited, personal, non-exclusive, and non-transferable authorization to use them solely to access the Service. Copying, commercializing, tampering with, or reverse-engineering them is not permitted except where allowed by law. Reports and photographs submitted by the User must be lawful; their submission authorizes Zoomy to use them only to the extent necessary to manage the Service, incidents, and claims, while respecting privacy and third-party rights.
Zoomy may suspend, restrict, or terminate access in cases of impersonation, proven or reasonably suspected fraud, dangerous use, serious breach, or failure to pay overdue obligations that are not reasonably disputed. Measures will be proportionate, with notice of the reason and an opportunity for review, except in cases of immediate safety risk, an instruction from an authority, or the need to prevent imminent harm.
Suspension will never involve deliberately immobilizing a moving vehicle in a dangerous manner or prevent return, access to receipts, or submission of complaints. The User may request closure of their Account without penalty through the Application or at info@zoomycr.com.
Account closure does not extinguish valid debts or the obligation to return a vehicle that is still rented, nor does it permit continued charges for services not provided. Credit balances will be settled in accordance with the accepted conditions and the law. The handling of personal data after closure will be governed by the Privacy Policy and statutory retention periods.
Zoomy will process personal data necessary for identification and contact, Account administration, payment methods, ride history, vehicle location, fraud prevention, assistance, and incident management, in accordance with Law No. 8968, its implementing regulations, and the Privacy Policy. Geolocation of vehicles may be necessary to operate the system and recover units, without this constituting a general authorization to track individuals for purposes unrelated to the Service.
The Privacy Policy, available in the Application before registration, will specify the data controller, purposes and legal bases for processing, categories of data, recipients and processors, transfers, protective measures, retention periods, and procedures for access, rectification, erasure, and other applicable rights. Payment providers will be involved only within their respective areas of activity and with the information required by law.
Acceptance of these Terms does not, in itself, authorize personalized advertising, commercial transfer of data, or promotional use of photographs. Optional processing will require specific and revocable consent where required by regulations, without affecting access to features that do not depend on such processing.
Zoomy may send operational communications essential for registration, security, billing, and the performance of Rides. Commercial messages will require the appropriate authorization and an easy means of opting out.
Disabling advertising will not prevent essential Service notifications.
Zoomy may amend these Terms for operational, technical, commercial, or regulatory reasons. Before material amendments take effect, Zoomy will make the new version available and notify relevant changes through the Application, the registered email address, or another suitable means.
Amendments will not retroactively affect Rides already contracted, accepted prices, or acquired rights. A person who does not accept the new conditions may refrain from initiating new rentals and request closure of their Account, but this does not release them from valid outstanding obligations. Immediate and reasonable safety instructions may be communicated without creating new charges that have not been accepted.
Zoomy will endeavor to maintain the Application and vehicles in proper working condition, but connectivity interruptions, updates, maintenance, and technical failures may occur. Zoomy will reasonably manage incidents attributable to it and will not charge for services that have not been provided. No technical difficulty excludes any applicable legal warranties or liabilities.
The displayed location, projected range, and suggested routes are indicative; Zoomy does not guarantee continuous availability or risk-free routes. The User must safeguard their personal belongings; any loss will be assessed in light of the circumstances and applicable legal liability. The involvement of hotels, partner establishments, payment operators, or other third parties does not relieve Zoomy of its legal obligations as provider of the Service.
These Terms do not exclude or limit consumers’ non-waivable warranties or rights, any liability imposed by law for defects in the vehicle or the Service, or compensation payable for personal injury or property damage. No general limitation of liability equivalent to the fees paid is established, nor any advance release from liability for willful misconduct, fault, breach, or circumstances prohibited by law.
These Terms will be interpreted and performed in accordance with the laws of the Republic of Costa Rica. The User may submit inquiries or complaints to Zoomy through the means indicated in this document, without any requirement to submit a prior complaint before resorting to the National Consumer Commission, other administrative authorities, or competent courts, depending on the subject matter.
These Terms are supplemented by the Vehicle Rental Agreement, the specific conditions of each Ride, and the Privacy Policy, communicated in advance where applicable. Specific conditions expressly accepted will prevail regarding the particular details of a rental, without overriding mandatory provisions of law or incorporating obligations, rates, or restrictions of which the User was unaware when contracting. The Privacy Policy governs data processing and does not constitute indiscriminate authorization for new uses.
Inquiries, requests for assistance, and complaints may be submitted through the Application or by writing to info@zoomycr.com, providing, where applicable, the Ride identifier and a description of the incident.
