1. Introduction

This Privacy Policy explains how Zoomy Costa Rica S.R.L., cédula jurídica 3-102-963844 (“Zoomy,” “we,” “us,” or “our”), collects, uses, shares, and protects personal data in connection with the Zoomy mobile application (the “App”) and the e-scooter and e-bike rental service (the “Service”).

Zoomy acts as the data controller for personal data collected through the App. This Policy should be read together with our Terms and Conditions of Use.

2. Information We Collect

Identity and contact data: name, email address, phone number, and date of birth provided at registration.
Payment data: card or payment-method details, processed and stored by our payment processor (Stripe), not directly by Zoomy.
Location data: real-time and historical GPS location of the Vehicle during a Ride, collected via the Vehicle's onboard IoT module.
Usage data: ride history, duration, distance, start/end points, unlock and lock events, and in-app interactions.
Device data: device type, operating system, app version, and IP address.
Support and communications data: messages, complaints, or correspondence you send to Zoomy support.
Identification documents: where required for age verification, incident investigation, or insurance claims.

3. How We Collect Information

Directly from you, when you register an Account, contact support, or complete a Ride.
Automatically, through the Vehicle's GPS/IoT module and the App, during active use of the Service.
From third parties, including our platform provider (Atom Mobility) and our payment processor (Stripe), who process data on our behalf or as independent controllers for their own services.

4. How We Use Your Information

To create and manage your Account and authenticate Riders.
To operate the Service: unlocking, tracking, billing, and ending Rides.
To process payments and charge applicable fees.
To ensure safety, investigate incidents, and respond to insurance or liability claims.
To detect and prevent fraud, misuse, or violations of the Terms and Conditions.
To communicate with you about your Account, Rides, or changes to our policies.
To comply with legal obligations, including requests from Costa Rican authorities.

5. How We Share Information

We share personal data only as necessary to operate the Service:

Atom Mobility (our white-label platform provider) — processes Account, Ride, and location data on our behalf to operate the App.
Stripe — processes payment information to charge Riders and manage transactions.
Magic Breeze Ventures LLC — our affiliated U.S. entity, which holds the payment merchant account through which transactions are processed.
Insurance providers and brokers (INS, and our brokers Purdy Seguros / Confía Corredora de Seguros) — in the event of an accident, claim, or investigation requiring incident data.
Legal and regulatory authorities — where required by Costa Rican law or a valid legal process.

We do not sell personal data to third parties.

6. International Data Transfers

Because our platform provider and payment processor operate internationally, your personal data may be transferred to and processed in countries other than Costa Rica, including the United States and countries within the European Union. Where this occurs, we require our providers to apply appropriate safeguards for the protection of your data.

7. Data Retention

We retain personal data for as long as necessary to provide the Service, comply with legal, tax, and insurance obligations, and resolve disputes. Ride and location history is retained to support safety investigations and insurance claims, after which it is deleted or anonymized unless a longer retention period is required by law.

8. Data Security

We apply reasonable technical and organizational measures to protect personal data against unauthorized access, loss, or misuse. No system is completely secure, and we cannot guarantee absolute security of information transmitted through the App.

9. Your Rights

Under Costa Rican law, you have the right to:

Access the personal data we hold about you.
Rectify inaccurate or outdated personal data.
Cancel (delete) your personal data, subject to legal retention obligations.
Oppose certain processing of your personal data.

These are commonly known as ARCO rights (Acceso, Rectificación, Cancelación, Oposición). To exercise these rights, contact us at info@zoomycr.com.

10. Children's Privacy

The Service is not directed at, and may not be used by, individuals under the minimum age set out in our Terms and Conditions. We do not knowingly collect personal data from minors.

11. Cookies and Tracking

The App may use device identifiers, local storage, or similar technologies to maintain your session, remember preferences, and analyze App performance. We do not currently use third-party advertising trackers.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be notified through the App or by email prior to taking effect.

14. Governing Law

This Privacy Policy is governed by the laws of the Republic of Costa Rica, including Law No. 8968 on the Protection of Persons Regarding the Processing of Their Personal Data.

1. Introducción

Esta Política de Privacidad explica cómo Zoomy Costa Rica S.R.L., cédula jurídica 3-102-963844 (“Zoomy”, “nosotros” o “nuestro”), recopila, utiliza, comparte y protege los datos personales en relación con la aplicación móvil Zoomy (la “Aplicación”) y el servicio de alquiler de patinetes y bicicletas eléctricas (el “Servicio”).

Zoomy actúa como responsable del tratamiento de los datos personales recopilados a través de la Aplicación. Esta Política debe leerse junto con nuestros Términos y Condiciones de Uso.

2. Información que Recopilamos

Datos de identidad y contacto: nombre, correo electrónico, número de teléfono y fecha de nacimiento proporcionados al registrarse.
Datos de pago: datos de tarjeta o método de pago, procesados y almacenados por nuestro procesador de pagos (Stripe), no directamente por Zoomy.
Datos de ubicación: ubicación GPS en tiempo real e histórica del Vehículo durante un Viaje, recopilada mediante el módulo IoT integrado en el Vehículo.
Datos de uso: historial de viajes, duración, distancia, puntos de inicio/fin, eventos de desbloqueo y bloqueo, e interacciones dentro de la Aplicación.
Datos del dispositivo: tipo de dispositivo, sistema operativo, versión de la aplicación y dirección IP.
Datos de soporte y comunicaciones: mensajes, quejas o correspondencia que usted envíe al soporte de Zoomy.
Documentos de identificación: cuando se requieran para verificación de edad, investigación de incidentes o reclamos de seguro.

3. Cómo Recopilamos la Información

Directamente de usted, cuando registra una Cuenta, contacta al soporte o completa un Viaje.
Automáticamente, a través del módulo GPS/IoT del Vehículo y la Aplicación, durante el uso activo del Servicio.
De terceros, incluyendo nuestro proveedor de plataforma (Atom Mobility) y nuestro procesador de pagos (Stripe), quienes procesan datos en nuestro nombre o como responsables independientes de sus propios servicios.

4. Cómo Utilizamos su Información

Para crear y administrar su Cuenta y autenticar a los usuarios.
Para operar el Servicio: desbloqueo, seguimiento, facturación y finalización de Viajes.
Para procesar pagos y cobrar las tarifas aplicables.
Para garantizar la seguridad, investigar incidentes y responder a reclamos de seguro o responsabilidad.
Para detectar y prevenir fraude, uso indebido o infracciones de los Términos y Condiciones.
Para comunicarnos con usted sobre su Cuenta, Viajes o cambios en nuestras políticas.
Para cumplir con obligaciones legales, incluidas las solicitudes de autoridades costarricenses.

5. Cómo Compartimos la Información

Compartimos datos personales únicamente en la medida necesaria para operar el Servicio:

Atom Mobility (nuestro proveedor de plataforma de marca blanca) — procesa datos de Cuenta, Viaje y ubicación en nuestro nombre para operar la Aplicación.
Stripe — procesa información de pago para cobrar a los usuarios y gestionar transacciones.
Magic Breeze Ventures LLC — nuestra entidad afiliada en EE. UU., que posee la cuenta comercial de pagos a través de la cual se procesan las transacciones.
Proveedores y corredores de seguros (INS, y nuestros corredores Purdy Seguros / Confía Corredora de Seguros) — en caso de accidente, reclamo o investigación que requiera datos del incidente.
Autoridades legales y regulatorias — cuando lo exija la ley costarricense o un proceso legal válido.

No vendemos datos personales a terceros.

6. Transferencias Internacionales de Datos

Debido a que nuestro proveedor de plataforma y procesador de pagos operan internacionalmente, sus datos personales pueden transferirse y procesarse en países distintos a Costa Rica, incluyendo Estados Unidos y países de la Unión Europea. Cuando esto ocurra, exigimos a nuestros proveedores aplicar las salvaguardas apropiadas para la protección de sus datos.

7. Conservación de Datos

Conservamos los datos personales durante el tiempo necesario para prestar el Servicio, cumplir con obligaciones legales, fiscales y de seguros, y resolver disputas. El historial de viajes y ubicación se conserva para respaldar investigaciones de seguridad y reclamos de seguro, tras lo cual se elimina o anonimiza, salvo que la ley exija un período de conservación mayor.

8. Seguridad de los Datos

Aplicamos medidas técnicas y organizativas razonables para proteger los datos personales contra el acceso no autorizado, la pérdida o el uso indebido. Ningún sistema es completamente seguro, y no podemos garantizar la seguridad absoluta de la información transmitida a través de la Aplicación.

9. Sus Derechos

Conforme a la ley costarricense, usted tiene derecho a:

Acceder a los datos personales que tenemos sobre usted.
Rectificar datos personales inexactos o desactualizados.
Cancelar (eliminar) sus datos personales, sujeto a obligaciones legales de conservación.
Oponerse a determinado tratamiento de sus datos personales.

Estos se conocen comúnmente como derechos ARCO (Acceso, Rectificación, Cancelación, Oposición). Para ejercer estos derechos, contáctenos en info@zoomycr.com.

10. Privacidad de Menores

El Servicio no está dirigido a, ni puede ser utilizado por, personas menores de la edad mínima establecida en nuestros Términos y Condiciones. No recopilamos conscientemente datos personales de menores.

11. Cookies y Rastreo

La Aplicación puede utilizar identificadores de dispositivo, almacenamiento local o tecnologías similares para mantener su sesión, recordar preferencias y analizar el rendimiento de la Aplicación. Actualmente no utilizamos rastreadores publicitarios de terceros.

12. Cambios a esta Política

Podemos actualizar esta Política de Privacidad periódicamente. Los cambios materiales se notificarán a través de la Aplicación o por correo electrónico antes de su entrada en vigencia.

14. Ley Aplicable

Zoomy fungiert als Verantwortlicher für die über die App erhobenen personenbezogenen Daten. Diese Erklärung ist zusammen mit unseren Allgemeinen Geschäftsbedingungen zu lesen.

2. Von uns erhobene Informationen

Identitäts- und Kontaktdaten: Name, E-Mail-Adresse, Telefonnummer und Geburtsdatum, die bei der Registrierung angegeben werden.
Zahlungsdaten: Karten- oder Zahlungsmethodendaten, die von unserem Zahlungsdienstleister (Stripe) verarbeitet und gespeichert werden, nicht direkt von Zoomy.
Standortdaten: Echtzeit- und historische GPS-Standortdaten des Fahrzeugs während einer Fahrt, erfasst über das bordeigene IoT-Modul des Fahrzeugs.
Nutzungsdaten: Fahrtverlauf, Dauer, Distanz, Start-/Endpunkte, Ent- und Verriegelungsereignisse sowie Interaktionen innerhalb der App.
Gerätedaten: Gerätetyp, Betriebssystem, App-Version und IP-Adresse.
Support- und Kommunikationsdaten: Nachrichten, Beschwerden oder Korrespondenz, die Sie an den Zoomy-Support senden.
Ausweisdokumente: sofern zur Altersverifizierung, Untersuchung von Vorfällen oder Versicherungsansprüchen erforderlich.

3. Wie wir Informationen erheben

Direkt von Ihnen, wenn Sie ein Konto registrieren, den Support kontaktieren oder eine Fahrt abschließen.
Automatisch, über das GPS-/IoT-Modul des Fahrzeugs und die App, während der aktiven Nutzung des Dienstes.
Von Dritten, einschließlich unseres Plattformanbieters (Atom Mobility) und unseres Zahlungsdienstleisters (Stripe), die Daten in unserem Auftrag oder als eigenständig Verantwortliche für ihre eigenen Dienste verarbeiten.

4. Wie wir Ihre Informationen verwenden

Zur Erstellung und Verwaltung Ihres Kontos und zur Authentifizierung von Fahrern.
Zum Betrieb des Dienstes: Entsperren, Verfolgen, Abrechnen und Beenden von Fahrten.
Zur Zahlungsabwicklung und Erhebung anfallender Gebühren.
Zur Gewährleistung der Sicherheit, Untersuchung von Vorfällen und Bearbeitung von Versicherungs- oder Haftungsansprüchen.
Zur Erkennung und Verhinderung von Betrug, Missbrauch oder Verstößen gegen die Allgemeinen Geschäftsbedingungen.
Zur Kommunikation mit Ihnen über Ihr Konto, Fahrten oder Änderungen unserer Richtlinien.
Zur Erfüllung rechtlicher Verpflichtungen, einschließlich Anfragen costaricanischer Behörden.

5. Wie wir Informationen weitergeben

Wir geben personenbezogene Daten nur insoweit weiter, wie dies für den Betrieb des Dienstes erforderlich ist:

Atom Mobility (unser White-Label-Plattformanbieter) — verarbeitet Konto-, Fahrt- und Standortdaten in unserem Auftrag zum Betrieb der App.
Stripe — verarbeitet Zahlungsinformationen zur Abrechnung von Fahrern und Verwaltung von Transaktionen.
Magic Breeze Ventures LLC — unser verbundenes US-Unternehmen, das das Zahlungs-Händlerkonto hält, über das Transaktionen abgewickelt werden.
Versicherungsanbieter und -makler (INS sowie unsere Makler Purdy Seguros / Confía Corredora de Seguros) — im Falle eines Unfalls, Anspruchs oder einer Untersuchung, die Vorfalldaten erfordert.
Rechts- und Aufsichtsbehörden — sofern nach costaricanischem Recht oder einem gültigen rechtlichen Verfahren erforderlich.

Wir verkaufen keine personenbezogenen Daten an Dritte.

6. Internationale Datenübermittlungen

Da unser Plattformanbieter und Zahlungsdienstleister international tätig sind, können Ihre personenbezogenen Daten in andere Länder als Costa Rica übermittelt und dort verarbeitet werden, unter anderem in die Vereinigten Staaten und Länder der Europäischen Union. In diesem Fall verpflichten wir unsere Dienstleister zur Anwendung angemessener Schutzmaßnahmen für Ihre Daten.

7. Datenspeicherung

Wir speichern personenbezogene Daten so lange, wie es zur Erbringung des Dienstes, zur Erfüllung rechtlicher, steuerlicher und versicherungsrechtlicher Verpflichtungen sowie zur Beilegung von Streitigkeiten erforderlich ist. Fahrt- und Standortverlauf werden zur Unterstützung von Sicherheitsuntersuchungen und Versicherungsansprüchen gespeichert und anschließend gelöscht oder anonymisiert, sofern keine längere Aufbewahrungsfrist gesetzlich vorgeschrieben ist.

8. Datensicherheit

Wir treffen angemessene technische und organisatorische Maßnahmen, um personenbezogene Daten vor unbefugtem Zugriff, Verlust oder Missbrauch zu schützen. Kein System ist vollständig sicher, und wir können die absolute Sicherheit der über die App übermittelten Informationen nicht garantieren.

9. Ihre Rechte

Nach costaricanischem Recht haben Sie das Recht:

auf die über Sie gespeicherten personenbezogenen Daten zuzugreifen.
unrichtige oder veraltete personenbezogene Daten berichtigen zu lassen.
Ihre personenbezogenen Daten löschen zu lassen, vorbehaltlich gesetzlicher Aufbewahrungspflichten.
bestimmten Verarbeitungen Ihrer personenbezogenen Daten zu widersprechen.

10. Datenschutz von Kindern

Der Dienst richtet sich nicht an Personen unterhalb des in unseren Allgemeinen Geschäftsbedingungen festgelegten Mindestalters und darf von diesen nicht genutzt werden. Wir erheben wissentlich keine personenbezogenen Daten von Minderjährigen.

11. Cookies und Tracking

Die App kann Geräte-Identifikatoren, lokalen Speicher oder ähnliche Technologien verwenden, um Ihre Sitzung aufrechtzuerhalten, Präferenzen zu speichern und die App-Leistung zu analysieren. Derzeit verwenden wir keine Werbe-Tracker Dritter.

12. Änderungen dieser Erklärung

Wir können diese Datenschutzerklärung von Zeit zu Zeit aktualisieren. Wesentliche Änderungen werden vor Inkrafttreten über die App oder per E-Mail mitgeteilt.
